Snus in Spain legal? What you need to know

Is snus allowed or banned in Spain? The answer depends on which product you're talking about. Tobacco-containing snus and tobacco-free nicotine pouches are subject to fundamentally different rules, and this distinction is almost always overlooked when the question of legality comes up. On top of that, the legal situation in Spain is actively changing right now.

Is snus legal in Spain?

Clearly and unequivocally: tobacco-containing snus may not be sold in Spain. This is not a Spanish peculiarity, but follows from the EU-wide ban on oral tobacco products, which has been in force since 1992 and is enshrined in the Tobacco Products Directive 2014/40/EU. In all EU member states except Sweden, the sale of tobacco-containing snus is thus prohibited. Spain implements this regulation without exception.

Important: Snus containing tobacco is banned in Spain. The legal situation is based on EU requirements and is implemented at the national level.

Sweden is the only exception within the EU. The country negotiated a special arrangement upon joining the EU in 1995 that allows the sale of snus domestically. For all other member states, including Spain, France, Germany and Italy, the sales ban applies without restriction. Snus vs. nicotine pouches: two products, two legal questions

The most common mistake with this question is treating snus and nicotine pouches as legally equivalent. As someone who deals with the regulatory classification of these product categories, I consider this distinction crucial.

Tobacco-containing snus contains tobacco plant material and therefore falls under the EU Tobacco Products Directive. Its sale is banned in Spain. Tobacco-free nicotine pouches, on the other hand, contain no tobacco — only nicotine plus carrier and flavouring agents. They do not fall under the same directive and are therefore regulated independently in each EU country, or in some cases not yet regulated at all.

Note: Nicotine pouches contain no tobacco and are assessed differently under the law. Equating them with snus is not correct.

Nicotine pouches in Spain: what currently applies

Tobacco-free nicotine pouches are not subject to an explicit sales ban in Spain so far. In practice, they are sporadically available in some tobacco shops in Madrid, Barcelona and Valencia. A clear legal basis expressly permitting or prohibiting their sale had been lacking until recently.

This is exactly what I've been actively tracking for months: in 2025, the Spanish government notified the European Commission of a draft Royal Decree (TRIS 2025/0044/ES) that aims to regulate nicotine pouches as their own product category for the first time. The draft provides for a nicotine limit of 0.99 mg per pouch and a ban on all flavours except tobacco.

Since most products available on the market have significantly higher nicotine levels, this regulation would effectively amount to excluding most pouches from the market. Several EU countries, including Sweden, Italy and Romania, have raised formal objections. As of early 2026, the decree had not yet entered into force. I recommend checking the current situation before travelling to Spain.

Taking snus to Spain: what is allowed?

This sales ban on tobacco-containing snus refers to trade within Spain. A different consideration applies to private imports for personal use — though this does not mean blanket approval either.

Within the EU, the free movement of goods for private use generally applies. Private individuals carrying snus or nicotine pouches in small quantities that are clearly not intended for resale are operating in a grey area that is not actively pursued in most EU countries. There are no fixed allowances for snus into Spain, unlike for cigarettes or alcohol. Being caught at the airport with larger quantities is not a position where one should expect tolerance. • Small quantities for demonstrable personal use are usually tolerated in practice, but are not expressly permitted under the law.
• Commercial importation — i.e. purchasing abroad for resale in Spain — is clearly not permitted.
• Nicotine pouches in travel quantities are currently less problematic than tobacco-containing snus, but the planned regulation in Spain makes caution advisable.
• The original packaging should always be kept so that the product and its ingredients are clearly identifiable.

Can you buy snus in Spain?

Buying tobacco-containing snus in brick-and-mortar shops in Spain is not possible. No legal retailer is permitted to sell it. What occasionally turns up in tourist areas operates outside the legal framework.

Nicotine pouches are harder to find in Spain than in Germany or Sweden, but not fundamentally impossible to locate. Some specialised tobacco shops in larger cities stock them. In my assessment, it is safer to bring your own supply from home rather than hoping to find them locally.

How other EU countries handle snus

Spain is not alone with its snus ban — this applies across the EU. What differs from country to country is the handling of nicotine pouches and the approach to private importation.

In Italy, the situation is similarly restrictive: tobacco-containing snus is banned and nicotine pouches are regulated. Alternatives for your Spain holiday

Switching to tobacco-free products is currently the most straightforward option for anyone travelling to Spain who doesn't want to go without nicotine. At least as long as the Spanish Royal Decree is not yet in force, nicotine pouches are the legally less complicated choice.

The legal situation in Spain regarding snus and nicotine pouches can be summed up in a few clear points. Tobacco-containing snus is banned. Nicotine pouches are in a regulatory process whose outcome is still open. Bringing small quantities for personal use is more tolerated in practice than buying locally, but is not a legally secure position.
