Tobacco snus may not be sold in Germany. That is the legal situation in Germany. At the same time, the term "snus" is today often used as an umbrella term for two very different product categories: classic tobacco snus from Sweden and tobacco-free nicotine pouches. Why is tobacco snus banned in Germany?
The basis is European law: The EU Tobacco Products Directive 2014/40/EU prohibits the sale of oral tobacco in all EU member states with a single exception: Sweden. The Scandinavian country negotiated a special regulation upon joining the EU in 1995, because snus is deeply rooted in its culture. This sounds contradictory, but it is not in terms of system logic: the legislator wants to dry up the market, not criminalise consumers. In practice, however, this also means: you simply cannot access legal sources in Germany.
What happens with imports: customs, bringing it in, online orders
Anyone travelling home from Sweden or Norway may bring small quantities of snus for personal use. Within the EU, German customs regulations generally allow a tolerance limit of up to 1 kg for personal use. From non-EU countries, stricter import restrictions may apply and goods can be confiscated.
Online orders are a different matter: formally, importing tobacco snus from abroad into Germany is considered placing it on the market and is therefore also prohibited. Customs can intercept packages. For smaller quantities, the goods are often simply destroyed.
