Is Snus Legal in Spain? What You Need to Know

Is Snus allowed or banned in Spain? The answer depends on which product you're talking about. Tobacco-containing snus and tobacco-free nicotine pouches are subject to fundamentally different rules, and this distinction is almost always overlooked when asking about legality. Additionally, the legal situation in Spain is currently actively changing.

I've been observing these developments for some time and explain here what currently applies and what should be considered regarding Spain and the legality of snus.

Is Snus Legal in Spain?

Clear and unambiguous: tobacco-containing snus may not be sold in Spain. This is not a Spanish peculiarity, but follows from the EU-wide ban on oral tobacco products that has been in force since 1992 and was codified in the Tobacco Products Directive 2014/40/EU. In all EU member states except Sweden, the sale of tobacco-containing snus is thus prohibited. Spain implements this regulation without exception.

Important: Snus with tobacco is banned in Spain. The legal situation is based on EU regulations and is implemented nationally.

Sweden forms the only exception within the EU. The country negotiated a special arrangement when joining the EU in 1995 that allows the sale of snus domestically. For all other member states, including Spain, France, Germany and Italy, the sales ban applies without restriction. Snus vs. Nicotine Pouches: Two Products, Two Legal Questions

The most common mistake with this question is legally equating snus and nicotine pouches. As someone who deals with the regulatory classification of these product categories, I consider this distinction crucial.

Tobacco-containing snus contains tobacco plant material and thus falls under the EU Tobacco Products Directive. Its sale is banned in Spain. Tobacco-free nicotine pouches, on the other hand, contain no tobacco, only nicotine as well as carrier and flavoring substances. They don't fall under the same directive and are therefore regulated independently in each EU country, or not at all yet.

Note: Nicotine Pouches contain no tobacco and are legally assessed differently. Equating them with snus is not correct.

Nicotine Pouches in Spain: What Currently Applies

Tobacco-free nicotine pouches are not yet subject to an explicit sales ban in Spain. In practice, they are sporadically available in some tobacco shops in Madrid, Barcelona and Valencia. A clear legal basis that expressly permits or prohibits their sale has been lacking until recently.

This is exactly what I've been actively following for months: The Spanish government notified the EU Commission in 2025 of a draft Royal Decree (TRIS 2025/0044/ES) that aims to regulate nicotine pouches for the first time as their own product category. The draft provides for a nicotine upper limit of 0.99 mg per pouch as well as a ban on all flavors except tobacco.

Since most products available on the market have significantly higher nicotine contents, this regulation would factually amount to market exclusion for most pouches. Several EU countries, including Sweden, Italy and Romania, have raised formal objections to it. By early 2026, the decree had not yet entered into force. I recommend checking the current situation before traveling to Spain.

Taking Snus to Spain: What's Allowed?

This sales ban for tobacco-containing snus refers to trade in Spain. For private import for personal use, a different consideration applies, but this also doesn't mean blanket approval.

Within the EU, free movement of goods for private use generally applies. Private individuals who carry snus or nicotine pouches in small quantities and these are clearly not intended for resale move in a gray area that is not actively pursued in most EU countries. There are no fixed exemption limits for snus to Spain, unlike for cigarettes or alcohol, for example. Being caught with larger quantities at the airport is not a position where one should expect tolerance. • Small quantities for demonstrable personal use are usually tolerated in practice, but are not expressly permitted legally.
• Commercial import, i.e. buying abroad for resale in Spain, is clearly not allowed.
• Nicotine pouches in travel quantities are currently less problematic than tobacco-containing snus, but the planned regulation in Spain makes caution advisable.
• The original packaging should always be retained so that the product and ingredients are clearly recognizable.

Can You Buy Snus in Spain?

Buying tobacco-containing snus in stationary retail in Spain is not possible. No legal dealer may sell it. What occasionally appears in tourist areas moves outside the legal framework.

Nicotine pouches are harder to find in Spain than in Germany or Sweden, but not fundamentally unavailable. Some specialized tobacco shops in larger cities carry them. In my assessment, it's safer to bring your own supply from home than to hope for availability on site.

How Other EU Countries Deal with Snus

Spain is not alone with its snus ban, this applies EU-wide. What differs from country to country is the handling of nicotine pouches and the handling of private imports.

In Italy, the situation is similarly restrictive: tobacco-containing snus banned, nicotine pouches regulated. Alternatives for Spain Vacation

Switching to tobacco-free products is currently the most uncomplicated option for everyone who travels to Spain and doesn't want to give up nicotine. At least as long as the Spanish Royal Decree is not yet in force, nicotine pouches are the legally more relaxed choice.

What to Clarify Before Vacation

The legal situation in Spain regarding snus and nicotine pouches can be summarized in a few clear points. Tobacco-containing snus is banned. Nicotine pouches are in a regulatory process whose outcome is still open. Bringing small quantities for personal use is more tolerated in practice than buying locally, but not a legally secure position.

I advise bringing supplies in reasonable quantities from home, switching to tobacco-free pouches, and checking developments in Spain before departure. The ongoing Royal Decree may further change the situation this year.
