Australia has some of the strictest nicotine rules in the world. Since 24 July 2026, the national medicines regulator, the Therapeutic Goods Administration (TGA), has closed the last legal routes to nicotine pouches. This guide explains what is allowed and what is not, based on the law on 13 October 2026.
In short
- Since 24 July 2026, there is no lawful way for consumers to buy or import nicotine pouches in Australia.[1]
- Shops and online sellers may not sell them.[1]
- Travellers may not bring them into the country. The Australian Border Force seizes and destroys them.[1]
- Snus with tobacco has been prohibited from supply in Australia since 1991.[1]
Are nicotine pouches legal in Australia?
No. According to the TGA, there has been no lawful pathway for consumers to buy or import nicotine pouches in Australia since 24 July 2026.[1]
In Australia, nicotine pouches are regulated as therapeutic goods, which is the legal category for medicines. No nicotine pouch is included in the Australian Register of Therapeutic Goods (ARTG), and the TGA has not evaluated any of them for quality, safety or efficacy.[1] A product without this registration may only be imported or supplied for research in clinical trials or under another statutory exemption.[1]
| Question | Answer since 24 July 2026 |
|---|---|
| Buy in a shop or online in Australia | Not allowed. Retailers and online sellers may not sell them.[1] |
| Import for personal use | Not allowed, even with a prescription.[1] |
| Bring them when you travel | Not allowed. The traveller's exemption no longer applies.[1] |
| Get them on prescription | Not possible. Doctors cannot prescribe them and pharmacies cannot supply them.[1] |
| Advertise them | Unlawful in all media, including online.[1] |
Are ZYNs legal in Australia?
No. ZYN is a brand of tobacco-free nicotine pouches, and the same rules apply to it as to all other nicotine pouches.[1]
The TGA rules do not name brands. They cover nicotine pouches as a product group, so VELO, ZYN and every other brand fall under the same restrictions.[1] No ZYN product is listed in the ARTG, because no nicotine pouch is listed.[1]
Can you buy nicotine pouches in Australia?
Not legally. The TGA states that it is illegal for retailers, including online sellers, to sell or supply nicotine pouches in Australia.[1]
Products that are still offered in shops or on websites are offered unlawfully. The TGA warns that some products may contain high levels of nicotine, that the label information may be wrong and that many are made in unregulated facilities.[1] The TGA asks anyone with information about unlawful sales to report it.[2]
Can you import nicotine pouches for personal use?
No. Since 24 July 2026, nicotine pouches can no longer be imported under the Personal Importation Scheme, even with a prescription from a doctor.[1][2]
The Personal Importation Scheme allows individuals to import therapeutic goods for personal use under certain conditions. Until July 2026, it was a possible route for nicotine pouches. The new regulations removed it.[2] Nicotine pouches that are imported into Australia are seized at the border and destroyed by the Australian Border Force.[1]
Can you bring nicotine pouches into Australia when you travel?
No. The traveller's exemption no longer applies to nicotine pouches.[1]
This also applies to small amounts for your own use. If you fly to Australia, do not pack nicotine pouches in your hand luggage or in your suitcase. The rules for other countries and for flights are explained in our guide on snus on a plane.
Can a doctor prescribe nicotine pouches?
Not any more. Since 24 July 2026, doctors cannot prescribe nicotine pouches and pharmacies cannot make or supply them.[1]
The TGA closed four pathways: the Special Access Scheme, the Authorised Prescriber Scheme, the Personal Importation Scheme and the exemption for compounding by pharmacists.[1][2] Approved nicotine replacement therapies, such as patches, gum and lozenges, remain available.[1]
Is snus legal in Australia?
No. Snus is a smokeless oral tobacco product, and it has been prohibited from supply in Australia since 1991.[1]
The TGA states that nicotine pouches are distinct from snus.[1] The ban on smokeless tobacco products is now administered by the Department of Health under the Public Health (Tobacco and Other Products) Act 2023, which took effect on 1 April 2024.[3] It is also illegal to sell or supply tobacco products to people under 18.[3]
Is snus illegal in Australia for personal use?
The federal rules described here focus on supply, import and advertising. The TGA does not describe the possession of a product for personal use as an offence on its nicotine pouch page.[1]
The practical effect is still clear: there is no legal source. Some states and territories also have their own strict controls or bans on nicotine pouches, and these remain in place.[1] If you live in Australia, check the rules of your state or territory as well.
What are the penalties?
The penalties for sellers and advertisers are high. Under the Therapeutic Goods Act 1989, advertising and supply offences can lead to imprisonment of up to five years or up to 4,000 penalty units, which the TGA states as AUD 1.456 million, or both.[1]
| Type of penalty | Maximum according to the TGA |
|---|---|
| Criminal penalty for advertising or supply | Up to 5 years of imprisonment or 4,000 penalty units (AUD 1.456 million), or both[1] |
| Civil penalty for an individual | Up to 5,000 penalty units (AUD 1.82 million)[1] |
| Civil penalty for a company | Up to 50,000 penalty units (AUD 18.2 million)[1] |
State and territory medicines and poisons laws can add further penalties.[1]
Why did Australia change the rules?
The TGA names the growing unlawful sale and advertising of nicotine pouches, many of them imported from overseas, as the main reason.[1]
According to the TGA, the products are promoted to young people through social media, which increases the risk of nicotine dependence. The TGA also states that the long-term health effects are unknown and that there is limited evidence that nicotine pouches help people to stop smoking.[1][2] The changes followed a consultation with health practitioners and tobacco control experts.[1]
